TERMS OF USE & MASTER SERVICE AGREEMENT

Be The Lightness Inc.
Effective Date: January 22, 2026

This Terms of Use & Master Service Agreement (“Agreement”) governs your purchase, access, participation in, and use of all offerings—digital, physical, or in-person—provided by Be The Lightness Inc., operated by Kate Gajewski (“Provider,” “we,” “us,” or “our”).

This includes, but is not limited to: healing services, Reiki sessions, energy work, intuitive mentoring, spiritual guidance, coaching, courses, virtual events, workshops, downloadable materials, recordings, communities, and physical products under Divine Rose Frequency, as well as any associated DBA brands including Kate Gajewski, The Lightness of Being, Divine Rose Frequency, Reiki With Kate (“Offerings”).

By purchasing, booking, accessing, or participating in any Offering, you (“Client,” “Customer,” or “You”) agree to be bound by this Agreement.

1. Scope of Offerings

Offerings may include:

Healing sessions, Reiki, energy work, intuitive or spiritual guidance

Coaching, mentoring, and educational programs

Digital courses, workshops, recordings, and downloadable materials

Live or virtual events, retreats, or group experiences

Memberships, communities, and discussion spaces

Physical products including jewelry, tools, or Divine Rose Frequency items

We reserve the right to modify, expand, remove, or discontinue any Offering at any time.

2. Medical, Mental Health & Professional Disclaimer

All services and content are provided for educational, spiritual, and personal development purposes only.

We do not provide medical, mental health, legal, or financial advice.
We do not diagnose, treat, cure, or prevent any medical or psychological condition.

You acknowledge that Reiki, energy work, spiritual mentoring, and coaching do not replace licensed healthcare or mental health services.
You agree to consult licensed professionals for any medical, psychological, or legal concerns.

3. Personal Responsibility & Assumption of Risk

You acknowledge that participation in healing, Reiki, coaching, spiritual work, and personal development is voluntary and may involve emotional, energetic, psychological, or physical experiences.

You accept full responsibility for your well-being before, during, and after participation.
You agree that you alone are responsible for your decisions, actions, interpretations, and outcomes.

You voluntarily assume all risks associated with participation, including emotional processing, energetic sensitivity, or unexpected personal insights.

4. No Guarantees or Promises of Results

We make no guarantees regarding:

Healing outcomes

Emotional breakthroughs

Business or financial success

Income generation

Relationship outcomes

Spiritual transformation

Personal growth or life results

All outcomes depend on individual effort, circumstances, mindset, and external factors beyond our control.

5. Right to Refuse or Terminate Services

We reserve the right to:

Decline service to any individual

End a session early

Remove participants from programs, communities, or events

Revoke access to content or services

if boundaries, respect, safety, energetic integrity, or payment obligations are not upheld.

No refunds will be issued in such cases.

6. Payment Terms, Refunds, & Chargebacks

ALL SALES ARE FINAL. NO REFUNDS. NO RETURNS. NO EXCEPTIONS, unless explicitly stated in writing.

This applies to:

Healing sessions

Digital products

Courses and programs

Events, workshops, and retreats

Memberships

Physical products

Deposits and retainers

Deposits

Deposits are non-refundable and reserve time, preparation, and energetic space.

Payment Plans

Failure to complete payment plans may result in immediate termination of access.

Chargebacks

Unauthorized chargebacks or disputes may result in permanent loss of access and collection action.

7. Scheduling, No-Shows & Late Cancellations

Missed or no-show appointments are non-refundable

Cancellations or reschedules require at least 24 hours’ notice

Late cancellations may be forfeited at our discretion

8. Third-Party Platform Disclaimer (Go High Level & Tech Providers)

Our website, scheduling, email delivery, SMS communication, payment processing, CRM, and course delivery may rely on Go High Level (GHL), Stripe, Square, Zoom, or other third-party platforms.

We are not responsible for outages, data loss, access interruptions, platform failures, or technical errors caused by third-party services.

9. Digital Products, Courses & Virtual Content License

All digital Offerings are provided as-is.

Purchasing grants a non-transferable, non-exclusive, revocable license for personal use only.

You may not:

Share login credentials

Distribute downloads

Resell or sublicense content

Copy, reproduce, or republish materials

Use content commercially without written permission

Access timeframes may vary. We reserve the right to update, modify, or remove content at any time.

10. Physical Products – Divine Rose Frequency

Physical products are final sale.
No returns or exchanges will be accepted.

We are not responsible for:

Shipping delays

Lost packages

Damage after delivery

Incorrect shipping addresses provided by the customer

If an item arrives damaged, contact [email protected] within 5 days with photos.

By purchasing physical products, you accept full responsibility for personal use and any physical, emotional, or energetic responses.

11. Intellectual Property & Content Protection

All Offerings, content, recordings, product designs, materials, formulations, branding, and language are the exclusive intellectual property of Kate Gajewski / Be The Lightness Inc.

Protected content includes:

Course materials

Reiki or healing frameworks

Digital downloads

Videos, audio, workbooks

Product designs and Divine Rose Frequency creations

Brand language, messaging, and proprietary systems

Unauthorized use may result in legal enforcement.

12. Recording, Media & Content Consent

Live sessions, classes, events, workshops, and group calls may be recorded.

By participating, you grant consent for recordings to be used for:

Education

Replays

Marketing

Internal training

If you prefer not to appear, keep your camera off or notify us in writing beforehand.

13. Community Conduct & Sacred Container Integrity

We maintain intentional, respectful, and energetically aligned spaces.

You agree to engage with:

Respect

Emotional maturity

Personal accountability

Ethical conduct

Non-harmful communication

We reserve the right to remove participants who violate boundaries, disrupt group safety, or compromise the integrity of the space.

14. Energetic Integrity Clause

Our work is offered as sacred, intentional, and energetically held.
By engaging in any Offering, you agree to participate with integrity, respect, openness, and self-responsibility.

We reserve the right to discontinue services if the energetic container is not honored.

15. Limitation of Liability

To the fullest extent permitted by law, Be The Lightness Inc. and Kate Gajewski shall not be liable for:

Direct or indirect damages

Emotional or psychological outcomes

Lost income or business opportunities

Personal injury claims

Spiritual, energetic, or subjective interpretations

Platform outages or data loss

Consequential or incidental damages

Total liability shall never exceed the amount paid by you for the Offering.

16. Disclaimer of Warranties

All Offerings are provided “as is” with no warranties, express or implied, including merchantability, fitness for a particular purpose, or accuracy.

17. Force Majeure

We are not liable for service delays or disruptions caused by events beyond our control, including natural disasters, illness, platform failures, government actions, or technical interruptions.

18. Non-Disparagement & Good-Faith Resolution

You agree not to make false, defamatory, or misleading statements about the Provider.

We encourage concerns to be addressed directly and in good faith before public claims.

19. Governing Law, Venue & Dispute Resolution

This Agreement is governed by the laws of the State of New York, United States.

Any disputes shall be resolved in New York state or federal courts, and you waive participation in class-action claims where permitted by law.

20. Entire Agreement & Severability

This Agreement constitutes the entire agreement between you and the Provider and supersedes all prior contracts, service agreements, or communications.

If any provision is deemed unenforceable, remaining sections shall remain in full effect.

21. Changes to Terms

We reserve the right to modify this Agreement at any time.
Continued participation constitutes acceptance of updated terms.

22. Messaging

Be The Lightness Inc. sends appointment reminders, booking confirmations, service updates, and optional messages about events, offerings, and special announcements. You can cancel the SMS service at any time. Just text "STOP" to the +15169285836. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected]. Carriers are not liable for delayed or undelivered messages

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies.
